With winter here, I wish all of you safe driving experiences wherever you may be, from Istanbul to Indianapolis. But sometimes, accidents do happen. And it could be useful for people to know their legal rights. Every region has its own guidelines for dealing with accidents. I can only speak for U.S. laws. And even those laws are not universal throughout the entire United States. Each state can have its own regulations.

If you live in a no-fault state, the law covers certain benefits even if you are at fault. Keep in mind that all states are not "no-fault" states. But in a no-fault state, the driver and passengers are eligible for certain benefits. If you look at the paperwork for your insurance policy, you could see no-fault benefits described as "personal injury protection."

These benefits cover medical expenses and lost wages after an accident. So even if someone hits a tree and no one else is at fault, they can still be eligible for these benefits in a no-fault state. The question that clients often ask me is why their own insurance has to cover their medical bills or lost income when someone else was at fault.

It's not my fault... why is my insurance paying these bills? I don't want my insurance going up. It's a good question. But that's the way no-fault insurance works. A major purpose is to ease the burden on the court system. People still sue the other side in court for their injuries. But no-fault covers the most basic benefits.
