Misunderstandings happen in life all the time. "I thought you were going to pick me up at the train station at 6:15, not 6:30." "I thought you were getting ice for the party on your way here." These are small misunderstandings. While they could be frustrating, they aren't usually costly. But when misunderstandings take place with something big, like a construction project, they can be costly.

In the case of business dealings, misunderstandings could lead to disputes. And disputes could lead to people stopping work or stopping payment. And a deal is brought to a halt. What are the options when the deal is broken? The best option is to be able to resolve the dispute and come to a compromise. Things stay on track, and no one goes to court. Less money spent fighting. Less money spent on lawyers. And both sides get something close to what they want in the end.

But if things go bad and a court must set damages, here's how it works. There are a few different forms of damages:

Compensatory damages - these are the ordinary money damages that someone suffers when a deal is broken. It covers the materials they bought, the wages they paid workers, the special equipment they scheduled, etc.

Restitution damages - this is meant to return the innocent party back to the position they would have been in if they never made the deal

Quantum Meruit - This is Latin and it roughly equates to paying the person for work that has been done to date. In other words, what has been done so far.

Misunderstandings in contract law can have small consequences or large consequences. For a bathroom renovation, a small misunderstanding could be nothing.
