Watching children play can teach us how things work with the law. When a bully takes another child's toy away, sometimes the victim will cry. But sometimes the victim will take that toy back, and attack the bully. In other words, "You're suing me? Well, here's my response. I'm suing you back!" They show they're not going to passively sit there and get beaten up legally.
I'm not saying that everyone who files a lawsuit is a bully. People often sue because they were actually wronged by someone. It could be for a broken contract... or even a misunderstanding... It could be a counterclaim. Or it could be a motion to dismiss. Or it could include other tactics.
The purpose is derail the original lawsuit. You're suing me?
- I'm the wrong person - I didn't cause your harm
- Your math is wrong - I didn't cause you that much damage
- Your lawsuit is too late - You missed the deadline
- Your lawsuit is not valid - That's not how the law works
The list can go on. The point is that the person who fights back shows that they are not a pushover. That could result in the original aggressor changing their approach.
