The photo below is a sad one. It shows the nose of the liner Titanic on the ocean floor. It was the site of a famous movie scene ("I'm the King of the World!"), and now it rests in the cold and dark depths of the North Atlantic. Titanic sank about 400 miles off the Newfoundland coast after hitting an iceberg on the night of April 14, 1912. Her wreck lies in water two miles deep. But the point is that such forms can be enforceable. In other words, they can hold up in court. Courts don't like them though. And if the tour operator does things that are reckless, then the waivers don't hold up. If the tour company lies about safety or the actual risks involved, then all bets are off and the tourist can sue.
