Law school is a unique educational experience. You learn by studying cases. You study cases about contract law, criminal law, and other interesting subjects. One of the first things you learn is how to analyze cases in a certain way. Law schools teach a technique for this that can be valuable for everyone... not only attorneys.

Here's how the technique works. First you read the case for the basic FACTS. You then look for the legal ISSUES. You look at the legal RULE that applies. Here's an example. Jack tells Jill he wants to buy her house. They discuss prices but Jill never accepts Jack's offers. Jill calls Jack a few times. She can't teach him. Jill finally sells the house to someone else. Jack later appears and tells Jill he wanted the house. He sues Jill for breach of contract. What will happen to Jack's lawsuit?

Let's apply our technique...

ISSUE - Was a CONTRACT formed?

RULE - A contract requires an OFFER and ACCEPTANCE.

ANALYSIS - If no offer and acceptance, there is no CONTRACT. Jill did not ACCEPT Jack's offers. Therefore, no contract was formed here.

CONCLUSION - If there is no contract, Jack has no legal right to sue. His lawsuit will be dismissed (thrown out of court).

This may be a somewhat simplified illustration. But the method doesn't change, whether the situation is a ten-dollar book being sold... or a $100,000 injury case from an accident.
